THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Who follows this notice
This notice applies to Botanica Beauty PLLC, its workforce, and its business associates, including BB MSO LLC in its capacity as management services provider. We are required by law to maintain the privacy of your protected health information ("PHI"), give you this notice of our legal duties and privacy practices, notify you following a breach of unsecured PHI, and follow the terms of the notice currently in effect.
How we may use and disclose your health information
Without your written authorization
- Treatment. To provide, coordinate, or manage your care — for example, your injector sharing your chart with our Medical Director, or with a specialist to whom we refer you.
- Payment. To obtain payment for services, including processing your card, working with a third-party financing provider you have applied to, or verifying eligibility.
- Health care operations. Quality assessment, provider review, training, business management, and administrative activities.
- Appointment reminders and follow-up care. To contact you about appointments, aftercare, and treatment alternatives or health-related benefits.
- As required by law. Including public health activities, reporting suspected abuse or neglect, health oversight activities, judicial and administrative proceedings, law enforcement purposes, and to coroners, medical examiners, and funeral directors.
- To avert a serious threat to health or safety.
- Workers' compensation as authorized by law.
Only with your written authorization
- Photographs and marketing. We will never use your image — including any before-and-after photograph, video, or social media content — for marketing or on our website without your separate signed authorization for that specific use. You may revoke that authorization in writing at any time.
- Marketing communications that involve payment to us from a third party.
- Sale of PHI. We do not sell PHI.
- Psychotherapy notes, where applicable.
- Most other uses and disclosures not described in this notice.
You may revoke an authorization in writing at any time. Revocation does not affect disclosures we already made in reliance on it.
Your rights
- Inspect and copy your record, including an electronic copy. We may charge a reasonable, cost-based fee.
- Request an amendment if you believe your record is incorrect or incomplete.
- Receive an accounting of disclosures we have made, other than for treatment, payment, and operations.
- Request restrictions on uses and disclosures. We are not required to agree, except that we must agree to restrict disclosure to a health plan for a service you paid for in full out of pocket.
- Request confidential communications by alternative means or at an alternative location.
- Receive a paper copy of this notice on request, even if you agreed to receive it electronically.
- Be notified if a breach occurs that compromises the privacy or security of your information.
- Choose someone to act for you — a personal representative with legal authority may exercise your rights.

Washington State law
Washington law provides certain protections stronger than HIPAA, including additional protections for records relating to reproductive health care, gender-affirming care, sexually transmitted infections, mental health, and substance use disorder. Where state law is more protective, we follow state law.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with us at privacy@botanica-beauty.com, or with the U.S. Department of Health and Human Services, Office for Civil Rights, 200 Independence Avenue SW, Washington, D.C. 20201, 1-877-696-6775, or at hhs.gov/ocr/complaints. You will not be retaliated against for filing a complaint.
Changes to this notice
We may change this notice and make the new notice effective for all information we maintain. The current notice will be posted in our reception area, on our website, and available on request.
